Association Statutes
for
Refugees Emancipation (RE e.V)
I Name, Registered Office, Objectives
Article 1: Name, Registered Office, Fiscal Year
The name of the association is: Refugees Emancipation (RE e.V)
It is entered in the register of associations of the District Court of Potsdam and carries the suffix e.V.
It has its registered office in Potsdam.
The fiscal year is a calendar year.
The association operates selflessly; it does not primarily pursue its own economic purposes. Refugees Emancipation (RE e.V) pursues exclusively and directly non-profit purposes within the meaning of the section "tax-privileged purposes" of the Tax Code.
Article 2: Purposes of the Association
The association purposes of Refugees Emancipation serve to promote aid for refugees and migrants with a refugee background in Germany, and the promotion of education.
These purposes are realized in particular through the following measures:
- Education by teaching computer skills to refugees and migrants (Word, Excel, Windows, Linux, websites, etc.) through the installation of computers and internet networks in shelters, and the operation/application of computers to grant them access to modern communication technologies.
- Emancipation and self-determination of refugees and migrants through education.
- Providing refugees and migrants with the opportunity to integrate into society, due to their social disadvantage.
- This applies to all instruments, events, such as assemblies, seminars, colloquia, conferences with the participation of asylum seekers, migrants, and German citizens.
- Emancipation of refugees through information about organizations and institutions that promote their education.
- Production of websites and print media, such as magazines for refugees.
- Instructing refugees and migrants in various subjects, such as project management, intercultural activities, and visual arts, with various German organizations.
- Organizing free German lessons for refugees and migrants.
- It is the task of all instruments, such as events, publications, etc., to draw the attention of political decision-makers to the demands of the members of Refugees Emancipation.
II Members
Article 3: Members
Refugees Emancipation is composed of various groupings: natural persons and organizations, as legal entities.
All adults living in Germany can become members. However, only natural persons who have refugee status or migrants who have a refugee background in Germany can have full membership and thus obtain the right to vote.
As an alternative to full membership, natural persons but also organizations can participate as members of Refugees Emancipation in other forms:
- as associated members
- as passive members
Membership includes for all members the right to participate in the general assembly.
Refugees Emancipation provides for three forms of membership:
Full Members
Are refugees and migrants who can join Refugees Emancipation under the following conditions:
- Support for the fundamental objectives of Refugees Emancipation and its basic documents, which are drafted through joint resolutions.
- Acceptance of the provisions of Refugees Emancipation (agreement to pay a membership fee).
Associated Members
Persons or organizations who are interested in certain projects of Refugees Emancipation, but without being involved in the full range of work.
Passive Members
Persons or organizations who support the work of Refugees Emancipation with their possibilities, through their commitment and expertise.
Article 4: Beginning and Termination of Membership
Membership begins with a written declaration and recognition of the association statutes of Refugees Emancipation.
Every member can terminate their membership in Refugees Emancipation at any time, in the form of a short written notice or through death.
Invitations
The invitation to the full members' assembly is issued by the Coordination Committee.
Invitations to the assembly are mainly sent by email. Only association members without a known email address are invited by letter with an invitation period of at least one month and announcement of the agenda items.
The invitation is deemed received if it was sent to the last known address of the member.
Resolutions
The resolutions of the full members' assembly must be signed by the elected chairperson of the assembly and the recording secretary.
Changes to the Statutes
Approval by 2/3 of the members of the association is required to change the purpose specified in the statutes or to change the statutes.
This change must be provided in a new protocol with the ORIGINAL signature of the recording secretary.
III Organs
Article 5: Organs of the Association
The Full Members' Assembly
The full members' assembly is the highest organ of Refugees Emancipation according to the statutes and takes place several times a year.
The Coordination Committee decides the agenda of the assembly and prepares the election of delegates. The sessions must be announced at least one month in advance. It:
- drafts documents of programs with a statutory character
- adopts programs and statutory documents
- makes decisions and adopts reports on the work of the organs between two sessions
- elects and dismisses coordinators and members of the Coordination Committee
- makes decisions regarding complaints and proposals
The General Assembly
Convening a general assembly including all supporters.
With a majority of 3/4 of all members of the Coordination Committee, the general assembly is held within one month.
The convening is done in writing by the Coordination Committee. Eligible to participate are:
- Full members
- Associated members
- Passive members
The general assembly must be marked with the ORIGINAL signature of the recording secretary.
The Coordination Committee
Refugees Emancipation is led by a Coordination Committee consisting of 3 members. It is the board of the association:
- Coordinator (administration, sole board member and administrative officer)
- Project and Training Officer
- Public Relations and Awareness Officer
All three board members are authorized to represent the association.
Article 6
The coordinator represents Refugees Emancipation according to Article 26 BGB.
He manages the organization and coordinates the work.
In their absence, the Project and Training Officer takes over the representation.
Article 7
The Coordination Committee determines the association's mode of action between two assemblies in accordance with the assembly resolutions.
It:
- accepts the financial planning and the factual report
- drafts rules and provisions concerning the management policy
IV Resources
Article 8
The financial resources consist mainly of:
- Donations
- Local subsidies
- Other legal means according to German legislation
Article 9
Association funds may only be used for the statutory purposes.
Members receive no allocations from the association's funds.
Article 10
No person may be favored by expenses that are foreign to the purpose of the corporation, or by disproportionately high remuneration.
V Final Provision
Article 11
The Refugees Emancipation statute can be changed with a 3/4 majority of all members of the assembly.
Article 12
In the event of dissolution or loss of tax-privileged purposes, the assets are transferred to another tax-privileged corporation in Brandenburg, with the obligation to use them explicitly and directly for the promotion of aid for refugees.
Article 13
Corporation funds may only be used for the statutory purposes. Members receive no allocations from the corporation's funds.
Article 14
No person may be favored by expenses that are foreign to the purpose of the corporation, or by disproportionately high remuneration.
